This course is aimed at providing delegates a sound knowledge and understanding of marine incident/accident investigations and dispute resolution. The course will introduce delegates various incidents and initial actions taken in an investigation, ways to manage the investigation, methods of physical collection and recommended interview techniques.
Delegates will also be exposed to the flag state investigations and legislation which applies as well as the latest MAIIB investigation manual.
Most importantly, delegates will gain in-depth understanding of dispute resolution arising therefrom followed by interactive training on what the main forms of dispute resolution are and how they proceed.

Captain Alan Loynd
Founder and Managing Director of Branscombe Marine Consultants Ltd., Master Mariner, 45 years of experience in the maritime industry
Captain Alan Loynd has more than 40 years of experience in the maritime industry. He established Branscombe Marine Consultants Ltd in April 2007 undertakes consultancy and project work, and a variety of surveys. He has also written a number of expert opinions and has recently acted as expert witness on major marine cases such as Hebei Spirit in South Korea and the collision between the bulk carrier Yao Hai and Neftegaz-67 in Hong Kong.
Captain Alan is highly sought after in the area of maritime incident and accident investigation. He was an Assessor on various Marine Courts of Enquiry and Boards of Investigation since 1990, including 'Apollo Jet' - the report from which led to a major revision of the rules for high speed craft in Hong Kong. He was also a member of several Boards of Discipline set up to investigate accidents to vessels with a pilot embarked.
He was also the member of the Pilotage Advisory Committee and PAC Working Group (1995 - 2007). During this period, Captain Alan sat on a number of pilotage enquiries and Boards of Discipline looking into the conduct of pilots during incidents and accidents. He was a member of the working group which established the system of continuous professional development for Hong Kong pilots.

Peter is a dispute resolution lawyer with 38 years of experience.
Among the principal areas of work undertaken include litigation with particular emphasis on the maritime industry in Asia such as:
• Salvage, collision, total loss of ships and cargoes, cargo claims, fire, pollution, general average, protection & indemnity, and marine insurance;
• Wreck removal, scrap sales, disposal of distressed cargoes, and damage to fixed and floating objects;
• Trade disputes, charterparty disputes, bill of lading claims, pilotage, and arrest of ships and cargoes;
• Crisis and casualty management, unsafe berth disputes, performance disputes, and personal injury and death claims;

Peter was admitted as a Barrister & Solicitor in New Zealand in 1979, as a Solicitor in England & Wales in 1984 and as a Solicitor in Hong Kong in 1990.

- MOCK ARBITRATION – with delegates playing roles from a case study
- An understanding of the mediation process, how to prepare to represent a party in a mediation, and how to act as mediator.
- Delegates will present their evidence in a mock mediation hearing before the course directors, who will then discuss the results and present their findings.
