This 3-day intensive workshop is specifically designed to ensure attendees understand critical success factors relevant to achieving effective delivery of construction projects, and gain a practical understanding of the critical elements within the procurement lifecycle. It covers the key elements, within the tender and contract documentation and the tendering and supplier selection processes, necessary to achieve desired outcomes. Attendees will gain in-depth knowledge on contractual issues arising from the tender process and during execution necessary to protect commercial outcomes.

 

The workshop also covers all aspects of dispute resolution under construction contracts from drafting dispute resolution clauses to issuing notices and then to the various dispute resolution options. It will explain each method in detail and then compare them with each other to enable you to assess which best suits your contract and your dispute.

Course Facilitator 1:

  • Actively involved in construction contract dispute resolution, acting in the roles of claims advisor, independent expert, mediator, adjudicator and arbitrator. An accredited Gateway Review team leader for project reviews of major capital projects with the New Zealand Government and Australian Federal and State Governments.
  • He was involved in the building and construction industry in New Zealand for the last 30 years as a project manager of capital works projects.
  • Managed complex multidisciplinary engineering and construction projects up to $200m in current value, in the petrochemical, infrastructure, health, prisons, and commercial sectors.
  • Clients include government departments in New Zealand, Australia, and Fiji. He has significant involvement in contractual disputes resolution for disputes arising from the earthquake rebuild in Christchurch New Zealand.
  • Delivered extensive services to the National Grid operator, and the leading construction companies in New Zealand. On top of that, Rob has undertaken consulting services, including disputes assistance in Singapore and Malaysia.

Course Facilitator 2:

  • Past partner in a law firm and then a barrister at the independent Bar in Australia, practising in commercial and administrative litigation.He later became Head of Dispute Resolution for four States for National Australia Bank.
  • Special counsel with Downer Group in Australia and in Singapore, managing a large construction arbitration under SIAC rules.
  • In 2011, he was acting Head of Legal for Oyu Tolgoi LLC, a Rio Tinto company in Mongolia.  In Mongolia, he oversaw a team of 10 lawyers working on the construction of the world’s largest copper and gold mine and attended to large construction projects including a $1bn power station in the Gobi Desert.
  • Registered adjudicator under a Security of Payment scheme in Australia and has conducted some 14 adjudications under that scheme.  An arbitrator on the arbitration panels of the Singapore International Arbitration Centre, the Singapore Institute of Arbitrators, the Hong Kong International Arbitration Centre, the Kuala Lumpur Regional Centre for Arbitration and the Beijing Arbitration Commission. 
  • Editor-in-Chief of the Northern Territory Law Reports for over 10 years and the Executive Editor of the Northern Territory Law Journal since its inception in 2007.
  • Founding Editor-in-Chief of the Australian Capital Territory Law Reports, a State editor of both the Australian Insurance Law Bulletin and the seminal text Family Provision in Australia
